Far better to go to small claims
Been there, resolution is aimed at appeasing both parties, not finding culpability.
I won my case and was awarded full costs, double result I thought.
The judge then awarded compensation equivalent to the costs, for the defendants 'disappointment'.
The defendant was a science and technology teacher.
Those who can, do, those who cant ? .
He was expecting an L shaped piece of granite weighing > 200Kg to be installed in one piece ( with a sink cut out in the middle).
Even his own expert witness said he would not do it.
HSE advice on manual lifting was also disregarded by the judge.
