Add a few floodlights pointing their way on the side of your property?

:) :) :)

That should make them want a hedge back quick..

Dont forget about P4 requirements.

If you sue the tree surgeons for negligence, their insurers will sue your neighbours for *can't be bothered to think through the exact cause of action but there will be one - negligence or breach of implied term in their contract, probably*, which will have one and the same effect.

Seriously, leave it a few days to calm down, and then do try to talk it through before sending letters, let alone solicitors letters. Do check the boundary position (often stated in the deeds) first so you know you are on solid ground as it were.

Really, really, really not the sort of thing to litigate over, good though it always sounds. I say that as a litigator (albeit not of this sort of stuff). You can request/insist/demand all sorts of things to get them to make amends at a neighbourly level without invoking laws and lawyers.

Thanks guys - as ever great advice.

Pretty sure that the hedge is ours since the cottage has been there about 300 years and the house next door about 10 years. The hedge is older than 10 years. Ergo it was planted by the then owner of the cottage but will check the deeds.

Hi roger

Sounds like a great welcome from them

First thing to establish is your land boundaries, as this could be a sticky subject if the hedge is not yours and it has been in place over 12 years (not exact check how long) then the owners of the land have taken no action it becomes part of your neigbours!!!!!!
The second point don,t get to upset with the wife, go after the tree surgeons as they where working on your land, without your permision, this is firstly trespass and secondly criminal damage.

But as everyone else has said don,t go to far down the legal route with them next door could cause more hassle than it,s worth.

Hope you get this sorted before xmas

Roger, if you have to pay them a visit B&Q are having a sale of Hatchets at the moment

But seriously, if you find it is your hedge replant it with fast growing trees like, as already suggested, Leylandii and if they complain just refresh their memories that it is your hedge and if anyone is going to do anything to it, it'll be you!

Good luck with it all.

From http://www.boundary-problems.co.uk/mainboundaries.htm

"Whose fence is it ?

The only sure way of knowing who owns the physical feature used as a property boundary is if its ownership is stated in your title certificate or deeds of conveyance. It may be expressed in writing, but it is sometimes shown on the plan instead by a T-mark: this takes the form of a letter "T", repeated around the edge of the property, with the base of the "T" against the boundary and the whole of the "T" inside the property that owns the fence. If neither owner can find such evidence, then you cannot tell who owns the fence or is liable for its repair."

hi roger,

had the same thing happen to us went out for the day came back and the rear hedge was missing next day a close board fence went up, next day the bloke came around and asked for the cost of the fence, i told him i wanted the hedge back because it was our's and he had no authorization to take it out and he could stick the money for the fence where the sun dose not shine he has not spoken to me since. not that i was worried i was going to put a fence up anyway.

if all else fails keep smiling
