Well guys, after my earlier post moaning about the company I work for trying to make us sign a zero hours contract today was D day. I am now on a my twelve week notice for not signing this amendment along with around thirty other fellow workers. Now it will go through the Union to a tribunal to see what the outcome is. I can still sign this up until the last day of my notice without any break in my employment/terms. I did give a good speech on the wrongs of taking this action and how I and many of my fellow workers feel on the subject I am pleased to say. (My boss did come and congratulate me on a good speech afterwards) but I am still on my notice. :roll: So if any of you guys out there need a good joiner in the Humberside area I may soon be available. :lol:
 
Sorry to hear that, I love the word consultation when used in this situation, having been consulted before I tend to find it is anything but. It's usually an instruction and you're told how it's going to be.

Those are my thoughts exactly Devonwoody. Simple matter of laying guys off until they are forced to seek other employment or sign on. :evil:

When one door shuts another soon opens.....
My boss laid off some people to save a bit but in the long run he got worse employees later...

sorry to hear about your situation mailee :( i have complete sympathy.. south york fire service who i work for is just going through a consultation process to change our shift patterns and attack our conditions .They have looked at the 98% vote to reject the new work regime which is 4X12 hour shifts 0900 to 2100 or 2100 to 0900 and dismissed it out of hand.... consultation your having a laugh!!! The real reason for change is a loss of 124 firefighters which equates to 1 firefighter per fire engine! :x because the shifts will be of equal length it means staff can be removed from night cover (most serious fires happen at night) and put to work doing community projects like school visits , putting up smoke alarms or our latest brainwave which is community cycling engagement.
Although my job looks like its safe i can see a 90 day notice coming....but i suppose i should have known the first cost cutting exercises in a recession are front line local authority services (libraries..nursing homes ..fire service etc..)

I have to say that this is a very poor show from an employer to what seem to be a trusted employee.

It occurs to my feeble brain that you might have a case for constructive dismissal. That is they forced you out by making unacceptable changes to your contract. Might be worth seeking a chat with a legal eagle who has experience of employment issues

The employer certainly doesn't seem to have been too bright in all this. They can't have been acting with professional advice as their actions seem counter to all good practice.

A claim for constructive dismissal would seem a clear route. The danger of course, is that they go bust before any settlement is made.

I would be pushing for a redundancy payout - at least that is guaranteed by the government if the company goes under.

Mailee...all I can say is to re-iterate my earlier comments and that you consult a lawyer/solicitor who specialises in employment law.

As the man says, seems like constructive dismissal to me. If you have a case then they'd be much better served offering you the statutory minimum, ie cheaper for them in the long run. They may be banking on you being unaware of employment law
 
Yes Roger noted and acted upon. We are seeing a solicitor tomorrow afternoon so should know a little more about how we stand in this situation. Ironballs, i have a feeling that is what they are up to, hoping we take their word for it and not investigating fiurther.

Good luck, Mailee - make sure that he/she is an employment specialist as employment law is tricky.

I had "trouble" with my old employer about 10 years ago.
I went to citizens Advice bureau, they were really good. Within 3 days of inital contact they got me an appiontment with a expert lawyer. It did'nt cost me a penny.

I stood up to the employer (at a disiplinary hearing) with the knowledge of the advice from CAB and they completely backed down.

I'd suspect CABs are rather busy at the moment though!
