As this thread is diversifying into generics:
Would it still be the driver's fault if he had said,
'Yes I saw the motorcyclist but considered him to be a sufficient distance away to allow me to complete my manoeuver safely'?
Judging speed of oncoming objects is much more difficult than that of traversing ones, even more so for the small frontal area of motorcycles.
It's not unreasonable for a driver to assume the other vehicle is travelling within the speed limit.
