The LA took more than 3 months to consider my claim (gathered dust on a desk methinks) then promptly flatly refused it as expected. I had however as advised, obtained info via a freedom of information request and some of the facts differed so a 2 page letter with loads of technical questions with the threat of more to follow was duly sent before I went on holiday and a follow up email on my return produced an answer i.e. "The highways manager says pay the claim" So a result for me and in fairness to them I managed a £72 discount off the cost which has pleased them.
I firmly believe however that the only reason they paid up was that it would cost a lot more to answer my questions than pay the invoice but their policy of automatically turning down every claim after keeping people waiting for long periods in a blatant attempt to sicken off the majority is highly questionable. Genuine claiments shouldn't need to jump through hoops!
